Oral Arguments Set to Review Justice Department Misconduct in Tony Viola's Case
Federal prosecutor Mark Bennett and FBI Agent Jeff Kassouf shifted evidence proving Tony Viola's innocence from the U.S. Attorney's Office in Cleveland to a multi-jurisdictional Task Force location, then pled ignorance to evidence stored at that location. After Tony's first trial, the Task Force's Office Manager, Dawn Pasela, provided Tony with that evidence, which Tony used to prove his innocence at a second trial on identical charges. Now, the government's "disclosure decisions" as well as prosecutorial misconduct throughout Tony's case will be explored in oral arguments in the United States Court of Appeals for the Third Circuit, Case # 18-2573.
